IMPORTANT NOTICE
Please read these Terms and Conditions carefully before using the MedJourney platform. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our platform.
1. INTRODUCTION AND DEFINITIONS
1.1 About Us
MedJourney (the "Platform" or "Service") is owned and operated by Tryzent Technologies Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at [Address to be inserted], India (hereinafter referred to as "Company", "we", "us", or "our").
1.2 Definitions
For the purposes of these Terms and Conditions:
- "AI Services" means the artificial intelligence and machine learning features provided by the Platform, including but not limited to report summarization, health interviews, and translation services.
- "Doctor" means a registered medical practitioner using the Platform's SaaS services for patient management and consultation.
- "Health Data" means medical reports, prescriptions, diagnostic test results, health records, and any other health-related information uploaded to or generated by the Platform.
- "Lab Partner" means diagnostic laboratories or pathology centers that use the Platform for report generation and customer management.
- "Patient" or "User" means an individual who creates an account and uses the Platform's consumer-facing services.
- "Personal Data" means any information relating to an identified or identifiable individual as defined under the Digital Personal Data Protection Act, 2023.
- "Smart Report" means AI-generated summaries, explanations, and visualizations of medical reports created by the Platform.
2. ACCEPTANCE OF TERMS
2.1 Agreement to Terms
By accessing, browsing, or using the MedJourney platform through our website (medjourney.ai), mobile application, or any other means, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy and any other applicable policies.
2.2 Age and Capacity
You must be at least 18 years of age to use the Platform independently. If you are under 18 years of age, you may only use the Platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms. For users creating health profiles for minors, verifiable parental or guardian consent is required as per the Digital Personal Data Protection Act, 2023.
2.3 Modifications to Terms
We reserve the right to modify, amend, or update these Terms at any time. We will notify you of material changes through email, in-app notifications, or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Platform after such modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Platform.
3. PLATFORM SERVICES AND SCOPE
3.1 Services Provided
MedJourney provides three categories of services:
3.1.1 Patient Services (B2C)
- Upload and storage of medical reports, prescriptions, and health records
- AI-generated plain-language summaries and explanations of medical terminology
- Health trend tracking with graphs and timelines
- Multi-profile family health management
- AI-guided health interviews to prepare for doctor visits
- Generation of visit preparation packs for medical consultations
- Telemedicine consultation booking and multilingual translation services (when available)
3.1.2 Lab Partner Services (B2B)
- Software-as-a-Service platform for generating Smart Reports
- Customer profile and report management system
- White-labeled report generation with branding customization
- Customer engagement tools including follow-up reminders and comparative analysis
3.1.3 Doctor Services (B2B SaaS)
- Practice management software with patient information access
- AI-powered pre-consultation summaries based on patient interviews
- Structured clinical note generation
- Prescription schedule generation with multilingual patient communication
3.2 Service Limitations and Availability
While we strive to provide continuous service, we do not guarantee uninterrupted access to the Platform. Services may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our reasonable control. We reserve the right to modify, suspend, or discontinue any aspect of the Platform with or without notice.
3.3 Future Features
The Platform may introduce additional features in the future, including but not limited to integration with national health data systems (such as Ayushman Bharat Digital Mission/ABHA), enhanced telemedicine capabilities, and advanced AI analytics. These features will be introduced with appropriate user consent and notification mechanisms as they become available.
4. CRITICAL MEDICAL DISCLAIMERS
4.1 Not a Medical Service Provider
IMPORTANT: MedJourney is a technology platform that provides health information management and organization tools. We do not provide medical advice, diagnosis, treatment, or professional healthcare services. The Platform is designed to assist with understanding and organizing health information, not to replace professional medical consultation.
4.2 AI-Generated Content Limitations
All AI-generated summaries, explanations, and health information provided by the Platform are for informational and educational purposes only. These AI outputs:
- Are not medical advice and should not be used as a substitute for professional medical judgment
- May contain errors, inaccuracies, or incomplete information
- Should always be reviewed and interpreted by qualified healthcare professionals
- Cannot account for individual patient circumstances, medical history, or comorbidities
- Do not establish any doctor-patient relationship between Users and the Company
4.3 Doctor as Final Decision-Maker
The treating physician or healthcare provider retains sole responsibility for all clinical decisions, diagnoses, and treatment plans. The Platform's AI features are designed as decision-support tools only. Healthcare professionals using the Platform must exercise their independent clinical judgment and verify all information before making medical decisions.
4.4 Emergency Situations
DO NOT USE THIS PLATFORM FOR MEDICAL EMERGENCIES. If you are experiencing a medical emergency, immediately call emergency services (108 in India, or your local emergency number) or visit the nearest hospital emergency department. The Platform is not designed for, and should not be used in, time-critical or emergency medical situations.
4.5 No Diagnosis or Treatment
Nothing on the Platform should be construed as diagnosing, treating, curing, or preventing any disease or medical condition. You should always consult with a qualified healthcare provider for diagnosis and treatment of medical conditions. Never disregard professional medical advice or delay seeking it because of information provided by the Platform.
4.6 Accuracy of User-Provided Information
The accuracy and usefulness of AI-generated content depends on the accuracy of information you provide. You are responsible for ensuring all uploaded medical reports and health information are accurate, complete, and from legitimate healthcare sources. The Company cannot verify the authenticity of user-uploaded documents.
5. USER ACCOUNTS AND REGISTRATION
5.1 Account Creation
To access certain features of the Platform, you must create an account by providing accurate, current, and complete information. You may register using:
- Email and password
- Google Authentication
5.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:
- Keep your password secure and not share it with others
- Immediately notify us of any unauthorized access or security breach
- Use a strong, unique password
- Log out from shared devices after use
We are not liable for any loss or damage arising from your failure to maintain account security.
5.3 Account Verification
For Doctors and Lab Partners, we may require additional verification including:
- Medical Council registration number verification (for Doctors)
- Business registration and licensing documents (for Lab Partners)
- NABL accreditation or other quality certifications (if applicable)
We reserve the right to refuse service or terminate accounts that fail verification or provide fraudulent credentials.
5.4 Multi-Profile and Family Accounts
Users may create multiple health profiles for family members under a single account. When creating profiles for:
- Minors (under 18): You must have legal authority (parent or guardian) and provide verifiable consent
- Adults: You must have explicit consent from the individual to manage their health information
You are solely responsible for obtaining and maintaining proper authorization to access and manage health information on behalf of others.
6. DATA PROTECTION AND PRIVACY
6.1 Compliance with DPDP Act 2023
We process your Personal Data in compliance with the Digital Personal Data Protection Act, 2023. Under this Act, health data is treated as regular personal data. Our detailed data processing practices are described in our Privacy Policy, which forms an integral part of these Terms.
6.2 Data Collection and Purpose
We collect and process Personal Data only for specified, lawful purposes:
- Providing Platform services (report storage, AI analysis, health tracking)
- Facilitating doctor-patient consultations and lab-customer interactions
- Improving AI models and service quality
- Compliance with legal and regulatory obligations
- Communication regarding services, updates, and support
6.3 Consent and Withdrawal
By using the Platform and uploading Health Data, you provide explicit consent for data processing as described in our Privacy Policy. You have the right to withdraw consent at any time by:
- Deleting your account through account settings
- Contacting our Data Protection Officer at info@medjourney.ai
Withdrawal of consent will result in deletion of your data within 90 days, except where retention is required by law.
6.4 Your Data Rights
Under the DPDP Act 2023, you have the right to:
- Access: Request a summary of Personal Data being processed
- Correction: Request correction of inaccurate or incomplete data
- Erasure: Request deletion of your Personal Data (subject to legal retention requirements)
- Grievance Redressal: File complaints about data processing through our Grievance Officer
- Nominate: Designate another person to exercise your rights in case of death or incapacity

6.5 Data Storage and Security
We implement industry-standard security measures including:
- End-to-end encryption for data transmission
- Encryption at rest for stored data
- Access controls and authentication mechanisms
- Regular security audits and vulnerability assessments
- Data residency in India-based secure cloud infrastructure
Despite our security measures, no system is completely secure. You acknowledge that you use the Platform at your own risk.
6.6 Data Breach Notification
In the event of a data breach that affects your Personal Data, we will notify you and the Data Protection Board as required by law, providing details about the nature of the breach and measures being taken to address it.
6.7 Children's Data Protection
For users under 18 years of age, we require verifiable parental or guardian consent before processing their Personal Data. Parents/guardians can manage consent and exercise data rights on behalf of minors through their account settings or by contacting info@medjourney.ai.
6.8 Cross-Border Data Transfer
Your Personal Data is primarily stored and processed in India. For service delivery purposes (such as AI processing through third-party APIs), data may be transferred to other countries. We ensure such transfers comply with Indian law and implement appropriate safeguards.
6.9 Third-Party Data Sharing
We may share your data with:
- Healthcare Providers: Doctors and labs you choose to share information with
- Service Providers: Cloud infrastructure, AI API providers (OpenAI, etc.), payment processors
- Legal Authorities: When required by law or to protect rights and safety
We do not sell your Personal Data to third parties. All third-party processors are contractually obligated to maintain data security and confidentiality.
7. SUBSCRIPTION AND PAYMENT TERMS
7.1 Free and Paid Services
The Platform offers both free (basic) and paid (premium) subscription tiers. Free services may have limitations on features, usage volume, or data storage capacity. Paid subscriptions unlock additional features as described on our pricing page.
7.2 Subscription Fees
Subscription fees are displayed clearly before purchase and include applicable Goods and Services Tax (GST). Fees may vary based on:
- User type (Patient, Doctor, Lab Partner)
- Subscription duration (monthly, quarterly, annual)
- Feature tier (basic, premium, enterprise)
We reserve the right to modify subscription fees with 30 days' advance notice. Price changes will not affect active subscriptions until renewal.
7.3 Payment Methods
Payments are processed through Razorpay, a secure third-party payment gateway. We accept the following payment methods:
- Credit/Debit cards (Visa, Mastercard, RuPay, American Express)
- UPI (Unified Payments Interface)
- Net Banking
- Digital wallets (Paytm, PhonePe, Google Pay, etc.)
We do not store complete credit card information on our servers. All payment data is handled securely by Razorpay in accordance with PCI-DSS standards.
7.4 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be notified via email at least 7 days before auto-renewal. You can disable auto-renewal at any time through account settings.
7.5 No Refund Policy
IMPORTANT: All payments made for MedJourney subscriptions and services are non-refundable and non-cancellable. By making a payment, you acknowledge and agree that:
- Digital Service Nature: As MedJourney provides digital services with instant access upon payment, all sales are final. Once you gain access to premium features, the service is considered delivered.
- No Refunds: We do not offer refunds for any reason, including but not limited to: change of mind, dissatisfaction with features, technical issues on your device, or partial subscription period usage.
- No Cancellation After Payment: Once a payment is processed successfully, the subscription cannot be cancelled or refunded. You may choose not to renew your subscription for the next billing period.
- Continued Access: If you choose not to renew, you will retain access to paid features until the end of your current subscription period.
Exceptional Circumstances: We may, at our sole discretion, provide refunds in exceptional cases such as: (a) Platform discontinuation by the Company, (b) proven technical failures preventing service access for extended periods despite support attempts, or (c) duplicate charges due to payment gateway errors. Such refunds will be processed on a case-by-case basis and are not guaranteed.
Free Trial Recommendation: We strongly encourage you to thoroughly evaluate our free tier features before purchasing a paid subscription to ensure the Platform meets your needs.
7.6 Payment Disputes and Chargebacks
If you have concerns about a charge, please contact us at info@medjourney.ai before initiating a chargeback with your bank or card issuer. Initiating a chargeback without prior communication may result in:
- Immediate suspension of your account
- Loss of access to all Platform services
- Termination of account if the chargeback is found to be fraudulent
If you successfully dispute a charge through a chargeback, we reserve the right to permanently ban your account and prevent future access to the Platform.
7.7 Taxes
All prices are inclusive of applicable Goods and Services Tax (GST) as required by Indian law. If you are a business customer requiring a GST invoice, you must provide your valid GSTIN during registration or in account settings.
7.8 No Shipping Policy
As MedJourney is a purely digital service, there are no physical goods to ship. All features and services are delivered electronically through the Platform immediately upon successful payment. No shipping charges apply, and no shipping or delivery-related terms are applicable.
7.9 Commission-Based Services
For certain services (telemedicine consultations, lab test bookings), we may charge commission fees to healthcare providers or facilitate payments where we act as an intermediary. Commission rates will be clearly disclosed in partner agreements.
8. INTELLECTUAL PROPERTY RIGHTS
8.1 Platform Ownership
The MedJourney Platform, including all software, algorithms, AI models, user interface designs, graphics, logos, text, and other content (excluding User Content) is owned by Tryzent Technologies Private Limited and protected by Indian and international intellectual property laws. The "MedJourney" name and logo are trademarks of Tryzent Technologies Private Limited.
8.2 Limited License to Users
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal or internal business purposes in accordance with these Terms. This license does not permit you to:
- Copy, modify, distribute, or create derivative works of the Platform
- Reverse engineer, decompile, or disassemble any software or AI models
- Remove or alter any copyright, trademark, or proprietary notices
- Use automated systems (bots, scrapers) to access or extract data from the Platform
- Sublicense, rent, lease, or transfer your rights to others
8.3 User Content Ownership
You retain ownership of all medical reports, health records, and other content you upload to the Platform ("User Content"). By uploading User Content, you grant us a limited, worldwide, royalty-free license to:
- Store, process, and display your User Content to provide Platform services
- Generate AI-powered summaries and analyses of your User Content
- Share User Content with healthcare providers you authorize
- Use aggregated, de-identified data for service improvement and AI model training
This license terminates when you delete User Content or close your account, except where retention is required by law or for legitimate business purposes (e.g., backups retained for 90 days).
9. PROHIBITED ACTIVITIES AND ACCEPTABLE USE
You agree not to:
- Provide false, inaccurate, or misleading health information
- Impersonate another person or healthcare provider
- Use automated systems to access or extract data from the Platform
- Introduce viruses, malware, or harmful code
- Use the Platform for illegal activities or to violate third-party rights
10. LIMITATION OF LIABILITY AND DISCLAIMERS
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES AND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM, OR ₹10,000, WHICHEVER IS GREATER.
11. TERMINATION AND ACCOUNT SUSPENSION
You may terminate your account at any time through account settings. We may suspend or terminate your account for violations of these Terms. Upon termination, your data will be deleted within 90 days except where retention is required by law. Paid subscriptions are non-refundable upon termination.
12. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Delhi, India. For grievances, contact info@medjourney.ai (acknowledgment within 24 hours, resolution within 30 days per IT Rules 2021).
13. GENERAL PROVISIONS
These Terms constitute the entire agreement between you and Tryzent Technologies Private Limited. If any provision is found invalid, it shall be severed and the remaining provisions shall continue in effect. Our failure to enforce any right shall not constitute a waiver.
